An appeals court reversed the dismissal of a discrimination case filed by a former St. Louis County diversity director who died four years ago.

Her husband, Louis Erby, has pursued her lawsuit following her death in July 2021.

St. Louis County Judge Ellen H. Ribaudo ruled last year that the late Hazel Erby's complaints, filed in 2020, were no longer valid because of her death. The appeals court ruling means the case can continue.

Erby was a longtime County Council member and the first Black woman to serve on the legislative body. County Executive Sam Page hired her in 2019 to direct the newly created office of Diversity, Equity and Inclusion.
