Montana’s highest court upheld the Department of Natural Resources and Conservation permit for the Black Butte Copper Mine.

Now the project can proceed as planned.

Montana Trout Unlimited, one of the groups that challenged the permit, took to social media after the decision. In a post they said this was a blow to the Smith River and future generations believing the proposed mine would cause significant water loss to the river.

“Given the value of water to all people and uses, including fish, wildlife, family homes and agriculture, this ruling is incredibly disappointing,” said Executive Director of Montana Trout Unlimited David Brooks in a statement . “Allowing mining companies a free pass on massive water use threatens the lives and livelihoods of all downstream water users, not to mention the health of the treasured Smith River.”

In a statement – Governor Greg Gianforte said the ruling is a win for the state’s economy and this paces the way for future investments by reinforcing Montana’s position as a leader in critical mineral production.

“Today’s ruling from the Montana Supreme Court is a significant win for our economy, our state’s mining industry, and workers at the Black Butte Copper Mine,” Gianforte said in a statement. “This decision ends years of litigation that held back investment and the creation of good-paying jobs for Montanans. I’m grateful to Director Kaster, DNRC, as well as the Department of Environmental Quality for their work to resolve these issues. By reinforcing Montana’s position as a leader in critical mineral production, we are paving the way for future investment. Together, we will continue to foster an environment where businesses can thrive, create good-paying jobs, and bring the American dream into greater reach for all Montanans.”
