Miller then turns around and gets close to Caron. "What were you going to say?" he asks her. She begins to speak, and he holds up his phone.

As he leaves, she shouts, "You (expletive) touched me! Don't you (expletive) touch me!" Caron then walks behind him, again telling him not to touch her.

Long played the video in court. It was also posted online, along with other clips showing the same incident from different angles.

Long said a video posted by one of the protesters shows that Miller was trying to get away from the group when they "continued to harass" him, but he added that it does not show the alleged assault.

Long noted that the warrant also says Miller is "said to have tapped the brim of the victim's baseball cap," which the attorney believes creates doubt about the credibility of the accusation.

He said the protester's behavior is indicative of what his client has faced for months.

"He turned around, shouldn't have," Long said as he addressed the judge. "But I could tell you, if people followed me or you around like these people do, and constantly harass and stalk you or me like these people do him, it would be hard to keep our emotions in check as well."

When asked about the incident after the hearing, Caron said she reported it because Miller crossed a line.

"When a woman sets a clear boundary and says, 'You're in my personal space,' the response isn't to threaten her further," Caron said. "That's not OK. You're not allowed to touch me."

Caron, a Myrtle Beach-area native, said she does not "harass" or "stalk" Miller. She said she began protesting at the church a few weeks after learning about the death of Miller's wife, Mica.

"This is my community," Caron said. "I am a concerned community member, because Mica Francis, her life mattered."

Miller's arrest comes less than a week after the FBI searched his house on Nov. 1. FBI agents have not released any information about what led to the search or if anything was taken from the home. Miller has not been charged with any federal crime.
