The US Naval Academy and US Department of Defense joined the Students for Fair Admissions in filing a joint motion for dismissal to close out litigation alleging the academy considered race and ethnicity in its admission process.

Both parties requested that the US Court of Appeals for the Fourth Circuit dismiss the conservative legal advocacy group’s appeal as moot, vacate the district court’s judgment and opinion, and remand the case with instructions to dismiss the case without prejudice, their motion filed Monday said.
