Wichita Falls police have charged a man in connection with an incident at a protest in downtown Wichita Falls on Feb 2, court records show.

Officers arrested Afredo Serna on Sunday and charged him with interference with public duties, a class B misdemeanor.

Serna was free Tuesday from the Wichita County Jail on a $5,000 bond, according to online jail records.

The misdemeanor is punishable by up to 180 days in jail, a fine up to $2,000 or both. Anyone charged with a crime is presumed innocent until convicted beyond a reasonable doubt in a court of law.

The alleged incident occurred during a protest of the Trump administration's immigration policies and drew several hundred participants to Park Central at Eighth Street and Scott Avenue.

According to allegations in an arrest affidavit, a policeman stopped Serna’s car at Tenth Street and Scott Avenue for not maintaining a single lane of traffic.

The affidavit alleges Serna yelled at the officer as he got out of his car and the officer tried to explain he was driving recklessly and causing a safety hazard.

Serna took a large flag from his car and yelled, “I’ll die behind this flag," according to allegations in the affidavit.

The officer ordered him several times to sit down in the car, but Serna instead waved the flag in the officer’s face, according to allegations.

The affidavit alleges about 200 people surrounded Serna’s car and began yelling. Two other officers arrived at the scene and, according to the court document, attempted to handcuff Serna.

Sgt. Brett Keith, police spokesman, said the following day that Serna was briefly detained but not arrested at the scene.

Keith said the protest caused no problems other than concerns about traffic on adjacent streets.

Serna was booked into jail on Sunday and released Monday on bond, according to jail records.
