In 1992, Richard Tipton and James Roane were part of a notorious Richmond gang that police say were responsible for a string of gruesome murders. Since then, they have awaited execution on federal death row. On Monday, they
saw their sentences commuted from death to life in prison as part of a parting act of clemency by President Joe Biden. In a statement, the White House said Biden believes that America must stop the use of the death penalty, except in cases of terrorism and hate-motivated mass murder. The two were part of a group called the Newtowne Gang, which included at least three other members: Corey Johnson, Vernon Lance Thomas and Sandra Reaves. The gang sold crack cocaine and resorted to killing rival drug dealers and potential police collaborators.

At least 11 people were shot or stabbed to death by the gang. Police said that in one killing, a gang victim was stabbed 85 times in the neck. Johnson, by then 55 years old, was executed in January 2021, a week before Biden took office. Johnson had sought for years to evade the death penalty, but his lawyers were unsuccessful in an effort which hinged upon proving that he had an intellectual disability.
Federal death row inmate James H. Roane Jr. of Richmond's Newtowne gang was also sentenced in 1993. Like Richard Tipton, his punishment is being converted to life imprisonment without the possibility of parole. Co-defendant Corey Johnson was put to death on Jan. 14, 2021. In a statement released by his defense team after his execution, Johnson said that he was “blind and stupid.” Tipton and Roane remained on death row. Shortly after taking office, Biden issued a moratorium on federal executions, which indefinitely paused death by lethal injection. With the commutation, the two will continue to serve the remainder of their sentences without the possibility of parole. The decision was criticized by former Richmond Sheriff C.T. Woody, who was the lead Richmond Police detective on the task force that investigated the Newtowne Gang members. Woody said the gang would kill three to four people at a time, and alleged that they were responsible for more murders than police could prove.

'This was a case that warranted the death penalty'
The lead federal prosecutor on the case was Toby Vick, who later served as Henrico County commonwealth's attorney. Vick said the Newtowne Gang was "particularly violent." "It's tough to find a nastier group than the Newtowne Gang," Vick said. "If the death penalty is ever warranted in cases, this was a case that warranted the death penalty." Vick believes their prosecution, as well as subsequent gang prosecutions of groups like the Johnson/Brown gang, made a difference in bringing down Richmond's murder rate. Vick's co-prosecutor, Buddy Parcells, called Biden's commutation order "appalling." "They killed 11 people in about 45 days," said Parcell. "It takes a lot of courage to hand down that sentence." Parcell said he had never seen anyone more deserving of the death penalty than the Newtowne Gang. The trio's trial lasted several months. Ultimately, all three were found a guilty, while a fourth member, Vernon Thomas, was sentenced to life in prison. A juror in the trial, Charles V. Guthrie, told The New York Times that jurors ultimately felt the death penalty was warranted for Johnson, Tipton and Roane because of the severity of gang's crimes. "A whole lot of prayer went into it," Guthrie said.

Biden in total commuted the death sentences of 37 federal inmates on Monday, preventing incoming President Donald Trump from carrying out executions. The commutations followed Biden's decisions to pardon his son Hunter and 39 others, and to grant clemency to 1,499 others. Trump takes office Jan. 20. Biden’s clemency move is part of a broader effort to limit the use of capital punishment. “Make no mistake: I condemn these murderers, grieve for the victims of their despicable acts, and ache for all the families who have suffered unimaginable and irreparable loss,” Biden said in a statement announcing his decision. “But guided by my conscience and my experience as a public defender, chairman of the Senate Judiciary Committee, vice president, and now president, I am more convinced than ever that we must stop the use of the death penalty at the federal level. In good conscience, I cannot stand back and let a new administration resume executions that I halted.” The White House released statements from over a dozen people who had advocated for this action and are now applauding the decision, including Martin Luther King III, the oldest son of slain civil rights leader the Rev. Martin Luther King Jr. “This is a historic day,” King said. “By commuting these sentences, President Biden has done what no president before him was willing to do: take meaningful and lasting action not just to acknowledge the death penalty’s racist roots but also to remedy its persistent unfairness.”
